Current situation of the Golden Visa in Spain
Last January 3, Organic Law 1/2025, of January 2, on Measures for the efficiency of the Public Justice Service was published, which, in its 21st Final Provision, introduces the amendment of Law 14/2013, of September 27, on support for entrepreneurs and their internationalization, by which investor visas (known as Golden Visa) are eliminated. This measure will come into force after 3 months, that is to say, next April 3, 2025, and on that date, all investor visas will be eliminated.
Features of the Investor Visa
The investor visa, which will be repealed on April 3, 2025, allowed foreigners to invest in real estate assets, public debt, investment funds, in Spanish companies. Investment funds, in Spanish companies or in Projects of General Interest, to obtain a residence visa in Spain.
What will happen with the Golden Visa visas in force and the applications in process?
The new regulations include transitional provisions to protect acquired rights.
Golden Visa applications in process: Applications submitted before the law comes into force, i.e. before April 2, 2025, will be able to continue the visa or authorization process in accordance with the regulations in force at the time of application.
Renewal of existing Golden Visa visas: Visas and authorizations already issued will remain valid until their expiration date, and renewals may be processed in accordance with the regulations applicable at the time of the original grant.
Can I still apply for the Golden Visa?
If you wish to invest in Spain, either through real estate or other assets, you can still do so by submitting your application before April 2, 2025. Please note that you will have to comply with all the requested requirements, and especially in the case of real estate, the registration in the corresponding Land Registry, once all the corresponding taxes have been paid.
